Terms of Use of Device and Mobile App

1. Introduction

1.1. Welcome to Steed Equine Monitoring Solutions OÜ mobile app and Steed device (the "App", "Device"). These Terms of Use ("Terms") govern your use of the App and Device, including any services or features offered through the App and Device. By accessing or using the App and Device, you agree to be bound by these Terms.

2. Use of the App and Device

2.1. The App is intended for personal, non-commercial use only. You may not use the App for any illegal or unauthorized purpose, and you agree to comply with all applicable laws and regulations.

2.2. The Device is intended for personal, non-commercial use only. The Device shall remain the property of Steed Equine Monitoring Solutions OÜ and is not transferrable to third parties without the express consent of Steed Equine Monitoring Solutions OÜ.

3. Account Registration and Subscription

3.1. In order to use the App and Device, you are required to create an account and pay for a subscription, provide certain information about yourself and your horses. You agree to provide accurate and complete information when creating your account and to keep your account information up to date and subscription in order.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Intellectual Property

4.1. All content included in the App and Device, including but not limited to text, graphics, logos, images, hardware and software, is the property of Steed or its licensors and is protected by copyright, trademark, patents and other intellectual property laws.

4.2. You may not use, reproduce, distribute, or modify any content, or reverse engineer the App and Device for any purpose whatsoever.

5. User Content

5.1. You may have the opportunity to submit or upload content to the App, such as reviews, comments, or other user-generated content ("User Content"). By submitting User Content, you grant Steed Equine Monitoring Solutions OÜ a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

5.2. You represent and warrant that you have the necessary rights to grant the above license to Steed Equine Monitoring Solutions OÜ and that your User Content does not violate the rights of any third party or any applicable law or regulation.

6. Privacy

6.1. Your use of the App and Device is subject to our Privacy Policy, which explains how we collect, use, and disclose your information. By using the App and Device, you consent to the collection, use, and disclosure of your information and generic information about your horse/s such as breed, gender, age, discipline as described in the Privacy Policy.

7. Limitation of Liability

7.1. In no event shall Steed Equine Monitoring Solutions OÜ, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, whether based on warranty, contract, tort (including negligence), or any other legal theory.

8. Governing Law

8.1. These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

9. Changes to These Terms

9.1. We reserve the right to update or change these Terms at any time. Any changes will be effective immediately upon posting the revised Terms in the App. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.
